Thursday, April 5, in Stearns County District Court, Timothy Richard Gilles aka Ricky Gilles, DOB 3/24/89 entered a guilty plea to two counts of fleeing a peace officer in a motor vehicle resulting in death and one count of fleeing a peace officer in a motor vehicle resulting in substantial bodily harm.
On Friday, April 15, 2011, at approximately 5 p.m., law enforcement officers attempted to stop a Jeep Grand Cherokee driven by Gilles at the intersection of Highway 15 and 2nd Street South in St. Cloud. Law enforcement officers were aware that Gilles had an active warrant for Controlled Substance Crime in the Second Degree. The Wright County Sheriff's Department also had probable cause to arrest the defendant for Assault in the Second Degree on a police officer and Fleeing Police in a Motor Vehicle, both of which stemmed from an April 6, 2011, incident in Wright County.
Gilles admitted that two marked squad cars, with lights and sirens activated, attempted to stop his vehicle in the left hand turn lane of northbound Highway 15 at 2nd Street South in St. Cloud. When the squad cars pulled up directly behind Gilles, he stated he made an evasive left hand turn around a vehicle, went over the center median, and proceeded at a high rate of speed westbound in the eastbound lane of 2nd Street South, a major thoroughfare. During this time, it was rush hour traffic and there were many cars coming toward Gilles in the same lane of traffic. With emergency lights and sirens activated, three marked squads pursued the defendant on 2nd Street South. The defendant admitted reaching speeds in excess of 70 mph. The posted speed limit is 40 mph. At the intersection of Waite Avenue and 2nd Street South, Gilles entered the intersection at a high rate of speed and crashed into a second vehicle that was making a left turn onto eastbound 2nd Street South. Gilles struck the second vehicle in the driver's side door, killing the 30-year-old male driver of the vehicle and substantially injuring the 22-year-old pregnant female passenger. The driver of the second vehicle was pronounced dead at the scene while the pregnant passenger was transported to the St. Cloud Hospital.
As a result of the crash, the pregnant passenger suffered a ruptured left diaphragm. The pregnant passenger's baby was prematurely delivered during an emergency C-Section. The baby was born on April 16, 2011.Ê The baby died on April 18, 2011 due to the injuries caused by Gilles.
Gilles also admitted these crimes he committed were aggravated in nature. He admitted his conduct was significantly more egregious and represented a greater than normal danger to the safety of others given the number of individuals he put at risk when he fled from the police.
The defendant entered a straight plea, meaning there is no plea agreement. The Stearns County Attorney's Office will be arguing that the defendant receive a sentence of 432 months (36 years) in prison for his crimes.
