Meeting was called to order at 7:00 p.m. by Mayor Tammy Konz. Councilmembers present: Tammy Konz, DuWayne Orbeck, Chris Jansky, Eric Loewen and Joe Krippner. Councilmembers absent: None. Others present: Jean Matua, Cary Maus, Tim Young, Tom Marquardt, Sandy Steinmetz, Andy Maus, Steve Maus, Ed Maus, Chris Langness, Tim Ellis, Jeff Orbeck, Tom Ehlinger and Chad Johnson. Motion Jansky/Krippner to approve the May 5, 2008 minutes as presented with corrections to page 2 and 4. MP Motion Loewen/Orbeck to approve the claims for May as presented. MP Motion Orbeck/Jansky to approve the following items on the consent agenda:  To disconnect all delinquent City utilities.  To change Resolution No. 05052008 Providing For The Sale Of $500,000.00 General Obligation Refunding Bonds, Series 2008A, 2. Meeting; Proposal Opening time from 7:00 p.m. on May 19, 2008 to June 2, 2008 at 7:45 p.m. to allow the State Bank of Kimball additional time to put their proposal together. MP Cary Maus presented information on the Firemen's Relief Association Retirement Finances. Motion Jansky/Krippner to approve an increase for the Firemen's Relief Association retirement from $775.00 to $825.00 per year of service effective Jan. 1, 2009. MP Motion Loewen Krippner to increase the firemen's hourly rate from $8.00 to $9.00 per hour effective with the 2009 - 2010 budget. MP Mayor Tammy Konz read a letter from the Kimball Area Historical Society in reference to the electrical quote for Phase III City hall restoration. Motion Loewen/Jansky to accept the quote from Fairhaven Electric in the amount of $2,261.58 for Phase III City hall restoration. MP Tom Marquardt of the Kimball Express Baseball Team presented a claim for the fertilizing of the Kimball Baseball Field in the amount of $409.00. Cleaning up of the shrubs and catch basin were also discussed. Motion Loewen/Jansky to reimburse the Kimball Express Baseball Team $409.00 for fertilizing the Kimball Baseball Field. Those voting in favor thereof: Tammy Konz, DuWayne Orbeck, Chris Jansky and Eric Loewen; those voting against: None; those abstaining: Joe Krippner as he is a member of the baseball team; those absent: None. MP Chad Johnson, Public Works discussed the bids received for crack filling. Streets covered by construction warrantee are not to be included with the bid pricing. Motion Jansky/Krippner to accept the quote of $6,705.30 from Hardline Asphalt for street crack filling and to not include street still covered by a construction warrantee. MP Chad Johnson reported on the claim made for sewage back up during sewer main cleaning. Motion Jansky/Krippner to reimburse claimant $39.99 for the cleaning supplies only. MP Andy Maus of A. M. Maus & Son gave a report on the City's water run off pond located east of the fire hall. Mr. Maus reported that he constructed this pond for the entire Maus Addition and had a water run off study done for this site by RCM (now SEH, Inc). As he sold lots in Maus Addition, he gave easement across his property to the pond site. City Engineer Jim Schulz stated that he found references in RCM's notes, but could not locate a water run off study for this site. Reference was made to a letter sent to all property owners in Maus Addition in Nov. 2007 about what needed to be done to pipe into the City pond and a meeting which took place May 22 with Mayor Tammy Konz and Councilmember Joe Krippner and some of the property owners in Maus Addition. Sandy Steinmetz of Styme's spoke about the possible installation of a swale on the east side of their property going south. City Attorney spoke about the laws of drainage, benefit versus burden, reasonable use of drainage easement which is a path or route, drainage easement being dedicated for public use, rules always changing for City and State, City policing powers and public easement use being determined by the City Council as they are the finder of facts and have to balance the risk, financing, urgency, etc. Options and cost of study were discussed. Mayor Tammy Konz called for a special meeting on Wednesday, May 28, 2008 at 6:00 p.m. to meet with all interested property owners in Maus Addition to discuss the drainage issue. Notice of the meeting will be sent to the property owners. Motion Jansky/Loewen to require Triple RRR Grill & Bar to modify their building permit to reflect the correct route taken for the water run off line piped into the City pond and to charge $20.00 for this amendment. Motion passed. Motion Jansky/Loewen to have the League of Minnesota Cities make the determination on the trespass claim with the Magnus Johnson/Linden Ave. Street Project. MP The need for new computers in the City office was discussed and more quotes will be obtained. Other items of discussion: four wheelers, side walk clean up by bar owners,   Hazel Ave. street project County funds due to City, cross walk enforcement, playground surround, advertising Adopt a Pot and flags.
