Notice of Public Hearing Stearns County Environmental Services - 2 variance requests

Notice is hereby given, pursuant to Minnesota Statute, Section 394.26, that the Stearns County Board of Adjustment, in and for the County of Stearns, will conduct a public hearing on Thursday March 25, 2010, in Conference Room 121 CDE, Stearns County Service Center West, 3301 County Road 138, Waite Park, MN, beginning at 6:30 p.m.

Purpose of the hearing is to consider the granting or denial of variances from the Stearns County Zoning Ordinance, Stearns County Subdivision Ordinance, Stearns County Sewage Treatment Ordinance, Stearns County Recreational Campground Ordinance, Stearns County Lodging Establishments Ordinance, Stearns County Children's Camps Ordinance, and the Stearns County Manufactured Home Parks Ordinance as follows:

Public Hearings:

To consider a variance request submitted by Danen Shiek, TBC Properties LLC, South Haven, MN from Sections 5.1.2 C(3), 9.9.10, 10.2.11 A(2)(b) and 10.2.17 B(1) of the Stearns County Zoning Ordinance #209 to construct a roof above an existing deck that is located 8 feet from the Ordinary High Water Level in the shore impact zone of Clearwater Lake and on a lot of record that is at 51 percent impervious lot coverage. Said Ordinance does not allow additions or alterations to structures located in the shore impact zone and allows for maximum impervious lot coverage of 25 percent in the Shoreland Overlay and R-1 Zoning Districts. Affected property: Lots 1 & 2, Block 3, Coe's Clearwater Augusta Passage, Sec 11, T121 R28, Fairhaven Twp. Property address: 12635 Bayview Rd, South Haven, MN.

To consider a variance request submitted by Michael & Barbara Manuel, Maple Lake, MN from Section 9.9.10 and 10.2.17 B(1) of the Stearns County Zoning Ordinance #209 to construct a 16 foot by 40 foot deck on an existing structure on a lot of record that is at 69 percent impervious lot coverage. Said Ordinance allows for a maximum of impervious lot coverage of 25 percent in the Shoreland Overlay and R-1 Zoning Districts. Affected property: Part of Govt Lot 4, Sec 1, T121, R28, Fairhaven Twp. Property address: 13195 Bayview Rd, South Haven, MN.

All applications and related information are on file with the Environmental Services Department, Room 343, County Administration Center, 705 Courthouse Square, St. Cloud, MN.

All interested persons are invited to attend said hearing or submit written testimony prior to the hearing date, either in support of or in opposition to the requests. Written testimony should be sent to the Stearns County Board of Adjustment, Stearns County Environmental Services Department, Administration Center Room 343, 705 Courthouse Square, St. Cloud, MN 56303.
