Notice of Hearing
Pursuant to Minnesota Statutes, Section 412.851, notice is hereby given that the City Council of the City of Kimball, Stearns County, Minnesota, will hold a public hearing on September 8, 2009, at 7:15 p.m. in the City Hall to consider vacating the portion of public easement located at 260 Magnus Johnson St. N., and legally describes as set forth in the Proposed Resolution attached.
A copy of the Proposed Resolution is attached to this Notice as Exhibit A.
Any person wishing to be heard concerning this matter may make comments to the Council at this time.

Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Kimball, Minnesota, was held on the 8th day of September 2009, at 7:15 p.m.
The following members were present:
and the following were absent: None.
Council Member _________ introduced the following resolution and moved for its adoption:
WHEREAS, the City Council by Resolution adopted the 17th day of August, 2009, called for a public hearing to consider vacating the portion of public easement legally described as follows:
See Exhibit 1 attached.
WHEREAS, pursuant to ten days mailed notice to each property owner affected by the proposed vacation, and pursuant to two weeks published and posted notice, a public hearing was held on September 8, 2009, at 7:15 p.m. at a regular meeting of the City Council of the City of Kimball at the City Hall to consider the vacation;
WHEREAS, it appears in the interest of the public to vacate the portion of the easement as proposed;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Kimball, Minnesota.
1. The portion of the public easement legally described as follows:
See Exhibit 1 attached, is hereby vacated.
2. The Clerk is directed to prepare a Notice of Completion of Vacation Proceedings and to file the Notice with the county auditor and the county recorder.
The foregoing resolution was duly seconded by Council Member ______ and upon being put to vote the following voted in favor thereof:

WHEREUPON, the resolution was declared duly passed and adopted.

I, the undersigned, being the duly qualified and acting City Clerk of the City of Kimball, Minnesota, do hereby certify that I have carefully compared the attached and foregoing Extract of Minutes of a regular meeting of the City Council of said City held on the 8th day of September, 2009, with the original thereof on file in my office and I further certify that the same is a full, true and complete transcript thereof insofar as the same relates to the Resolution Vacating Easement.

An easement for constructing and maintaining a roadway and for utilities of the area described as follows: Start at the Northease corner of Lot Ten. Brower's Addition to the Village of Kimball, thence North Two Hundred Eighteen and Thirty-five Hundreths feet; thence angle Left Ninety Degrees Fifty-One minutes Six Hundred feet; thence angle Right Ninety Degrees Three Hundred Fifty feet to the starting point of the description of the area on which the easement is to be granted; thence at right angles to the Right Two Hundred feet; thence at Right angles to the Left Fifty feet; thence at right angles to the Left Two Hundred feet; thence at right angles to the Left Fifty feet to the starting point.
